I had a title loan that unfortunately I got behind on. Well, the title company called out a tow driver on July 4th to harrass my neighbors who were outside in their backyard barbquing and he drove his tow truck up on my lawn across my grass and shoved in my wood fence to my back yard damaging my fence and then he started beating and yelling on my door and I called the Shelby County Sheriff 's Department in Memphis, Tennessee.
The deputy I spoke to told me that if he had to come out or if anyone would come out they would make me open up my garage and give my car. He said I should have paid and that man had a right to get that car any way necessary. The deputy was angry and screaming at me and I was shocked. He made me feel as if I could not refuse even if I was on my own property. I hung up with him and called a lawyer and even though it was on a Holiday by the grace of God a lawyer answered the phone. A young attorney who told me he was heading out to a picnic.
However, he had me explain what was going on and he informed me that unless the tow driver had a writ of possession from the courts it was purely a civil matter and that officer did not know what he was talking about. He then told me call the officer back and ask him what law school did he go to. He told me my car was in the safest place possible and that unless he had that document from the courts he was trespassing. Of course the tow driver did not have any paperwork from the courts because when I asked him he said no. Even to this day I consider that Attorney, name unknown, A Godsend.
Officers sometimes don't understand the law which is why so many cases get thrown out.
Everyone is a perp and police today revel at the idea of criminalize any and all activity. The United States is a police state folks. Time to put a stop to it. By any means necessary.
